- issues around the island. We hope you find it useful.

- FARM DWELLING PERMITS BEING ISSUED ON THE BIG
ISLAND
-
- Contrary to some rumors, the Planning Department has
NOT
- instituted a moratorium on "farm dwellings" or
"additional
- farm dwellings." RATHER, the Planning Department
continues
- to receive and review applications for homes in
the
- agricultural district based upon the Zoning Code and
the
- State Land Use law.
-
- When an individual applies for a building permit for
the
- FIRST house on a lot in the agricultural district,
the
- Planning Department will check for setbacks and other
basic
- requirements. If the application meets those
requirements,
- the Planning Department will approve the building
permit.

- However, if the lot in question was created after
June 4,
- 1976 (the date of a change in state land use law)
the
- Planning Department will also give the applicant a
Farm
- Dwelling Notice which informs the applicant that the
home
- must be used as a "farm dwelling."
-
- A "farm dwelling" is a single-family dwelling located
on or
- used in connection with a farm, including clusters of
single
- family farm dwellings permitted within agricultural
parks
- developed by the State, or where agricultural
activity
- provides income to the family occupying the dwelling.
The
- Farm Dwelling Notice is a notice only. It is not a
separate
- application.

- Any ADDITIONAL dwelling (after the first one) on
an
- agricultural lot must be a "farm dwelling", and is
allowed
- only if:
-
- (1) a farm dwelling agreement for each additional
farm
- dwelling, on a form prepared by the planning
director, is
- executed between the owner of the building site, any
lessee
- having a lease on the building site with a term
exceeding one
- year from the date of the farm dwelling agreement,
and the
- County. The agreement shall require the dwelling to
be used
- for farm-related purposes.

- (2) The applicant submits an agricultural development
and use
- program, farm plan or other evidence of the
applicant's
- continual agricultural productivity or farming
operation
- within the County to the planning director. The plan
shall
- also show how the farm dwelling will be utilized
for
- farm-related purposes.

- "Farm" means land used for the purpose of
agricultural,
- livestock, poultry, or aquatic production.
-
- There are special conditions that apply to
certain
- agricultural lands. For example, the conditions of
rezoning
- for some properties forbid additional dwellings, or
impose
- more specific agricultural use conditions.
-
- These legal requirements are not new. The state land
use law
- regarding farm dwellings has been in effect for more
than 24
- years, and the county law allowing additional farm
dwellings
- has been in effect since 1996.

- KONA - GREAT NEWS ON LAKO STREET - MAKAI &
MAUKA

- Lako Street Makai - Planning and Design Progress
-
- Public Works is organizing a public meeting in
late-February
- to discuss the Lako Street makai extension. The
project will
- extend Lako Street makai to Alii Drive. The
meeting
- (specific date, location, etc. to be finalized) is to
discuss
- the project and get the community involved in the
planning
- and design process. More info to follow.

- Lako Street Mauka - Moving Forward

- Gamrex (land owner and developer for the Kona Vistas
project)
- plans to submit applications and plans for Kona
Vistas II
- next week. Once approved, they intend to immediately
begin
- construction of the mauka connection of Lako Street.

- KOMOHANA BRIDGE DEDICATED FEBRUARY 8
-
- Mahalo and congratulations to all involved in
the
- construction of Komohana Bridge. The November
floods
- destroyed the bridge and culvert, cutting an
important
- transportation link in Hilo. The replacement
bridge
- construction was dedicated February 8. This
project
- illustrates the success you can have when there
is
- cooperation. Mahalo to the County, State, Federal
and
- private parties that made this project a success (a
model
- public/private cooperative effort.)
